(a) If the council is of the opinion that it is necessary to prosecute a person or organization for violating the provisions of this Act, then the council may pass a resolution to prosecute and submit it to the Government of Nepal.

< p>(b) Government of Nepal may give authority in writing to any officer to conduct the proceedings of such case.
